Hello everyone... Tom has been working very hard on our proposal. We can now release it for all of you to get a better idea of what our group has come up with. The work begins... please suggest changes, oppositions, additions, etc. We need to cover our bases and do it right the first time. We also all need to be on board. I didn't do so hot at the hearing - sorry for that. The good news is there were lots of folks there that did a really great job. The only two that spoke in support besides Parks were a Doctor with Safekids and Joann Fairchild from Safekids. They asked to raise the age preferably to 16 but would settle for 12. It was a very short hearing and most of the people that came didn't have a chance to speak. The majority was pretty clear on not supporting an age limit. There were a few other things we would like changed and they seem easy to do. We also want confirmation on the type of safety training program they intend to use and if it is based on rider fit or the old standard of cc/age with ASI. Hopefully we can figure it out and change our opposition to support!! I am beat....too little sleep, too much activity. I am expecting that the next few weeks will be very quiet. I have a meeting with Devlin on the 20th and will update you on that. Our bill has several Senators and our favorite Rep. willing to sponsor it. We have some time to fine tune it and have it ready for next session. We hope to put a grant together under Safetyride that will bring us all together, provide club, dealer, manufacturer, laws, parks, etc links on a joint website. We want to also implement safety support, Quad Squad (members who pass out safety info when they see a violation), and a statistical data site. We have contacted Parks regarding this and are waiting to hear back. Senate Bill 49 is still in Committee. Until it has a hearing scheduled it will stay there - possibly forever. Senate Bill 101 is in the hearing process so we need to pay attention to see if it moves to the floor or has another hearing. Until then we need to focus on our Bill and what direction we want to go. DRAFT #3 From Safetyride...in memory of Olivia MARCH 11, 2007 CLASS I, II and III OHV Class I Definition: Class II Definition Class II Definition: Vehicles less than 53" wide and For vehicles more 53” wide or more For Vehicles riding on two tires and Dry weight of 1000 LBS or less Or Dry weight of more than 1000 LBS Dry weight of less than 600LBS Have a saddle seat and but less than 12,000 pounds and driving travel on three or four tires controls of a car (Steering Wheel, Including Odysseys and Pilots Foot Pedals) Single seat Mini rails under 650cc and Rails over 651 cc single or multiple seats. Legal operation of Class I, Class II and Class III vehicles on Public Domain Land in Oregon. Class I Class II Class III 16 years of age or older and possess A valid driver’s license 16 years of age or older and a Safety Training Certificate. possess a Safety Training Or Qualifying Youth Certificate. Or Qualifying Youth All vehicles may only operate on private land owned by the operator or with the permission of the land owner or Public domain land designated for such use. Riding in undesignated Public areas will result in (3) times restitution of echo system damage, plus a fine of $250 first offense and $500 second offense and loss of operational permit of OHV for 6 months. Riders must follow all Local and State Ordinances for operation on roads and property. Youth operation of Class I and III vehicles on public and private lands*. All riders under 18 years of age must wear a DoT approved helmet with chin strap secured . If child is caught not wearing a helmet, Parents or Legal Guardians will be fined: $100 for first offense, $250 for second offense, Third offense will result in loss of driving privileges for 30 days. Children under the age of 16 may only operate Class I or Class III vehicles: With a Safety Training Certificate: Safety Training will be offered through Oregon Parks and Recreation, Certified Safety Training Courses or the ASI. Training will be based on Rider Fit. The operator needs to reach and safely operate all controls and turn steering left and right while seated. For ATV’s and ORMC the rider must have a minimum of 3” from inseam to seat while standing and legs should be bent at 90 degree angle when seated and feet on foot pegs or floor boards. The instructor, utilizing best fit guidelines, will make the determination if the child fits and may safely operate the ATV. The Safety Certificate will only be valid for the vehicle size the youth trains on. The Youth may retest at any time to upgrade the certificate. Parents will be required to complete the STC with their child unless they already posses a STC Group I 90cc or less. Group II 91cc to 250 cc. Group III 251 cc and greater. If a child operates a Class I or Class III vehicle without a STC, Parents or Legal Guardians will be fined: $200 for first offense, $500 for second offense, Third offense will result in loss of driving privileges for 30 days. With the Constant Visual Supervision of an Adult with a Safety Training Certificate: Visual supervision is defined as constant observation by the unaided eye and the ability to come to the immediate aid of the child rider. If a child operates a Class I or Class III vehicle without Constant Adult Supervision the Parent or Legal Guardian will be fined $250 for first offense, $500 for second offense, third offense will result in loss of driving privileges for 90 days and a $1000. If the child is unsupervised and involved in property damage or injury accident the Parent or Legal Guardian they will be charged with negligence in addition to the fine schedule above. If the accident involves death, the Parent or Legal Guardian will be charged with Negligent Homicide (child endangerment). The owner or person in control of a Class I or Class III vehicle is also responsible if their vehicle is operated by a child under 16 years old. Children under the age of 18 will not operate a vehicle with a passenger unless it is with a Parent or Legal Guardian with a STC in a training situation. . *Exclusions: A farming and ranch exclusion will apply to the helmet and supervision portions of this bill as long as the child is directly participating in a farming or ranch activity. If the youth is riding on a farm or ranch land for recreation, Helmets and Supervision will be required. There is no exclusion for safety training. ACCIDENT REPORTING The operator of an ATV involved in an accident that causes injury or death to any person or more than $250.00 in property damages will be required to submit an accident report to the Oregon Parks and Recreation Department within 30 days of incident. Forms are available at the Parks and Recreation web site, DMV, Parks and Recreation info centers. Failure to file an Accident Report $200 first offense, second offense $500 fine and 30 day license suspension. ENFORCEMENT All law enforcement officers in the State including Local and State Police, Federal Park Rangers and BLM Rangers are authorized to enforce the Oregon OHV Law. Local and State Police have enforcement authority on private land.
