Attached are the dash 4 amendments to SB 101 to go along with the previously drafted dash 1 & 2 amendments. All three amendments will be combined into a dash 5 amendment for Monday's work session. The amendments do the following things:
Dash 1 Expand the allowable use of funds within the ATV Allocation Account to allow funding of law enforcement activities outside of designated ATV riding areas.
Dash 2 Provides a phase-in of the mandatory safety training.
Dash 4 These amendments were negotiated by Kyleen and her staff with the ATV user group. They accomplish the following: 1. Changes premises open to the public to public land 2. Change the supervision on same class of vehicle to able to provide immediate assistance and direction 3. Remove the proposed minimum age restriction for Class I and replace with rider fit guidelines established by OPRD rule 4. Increase the penalty in 821.170(3) to class C
Senator Devlin plans to testify in favor of the amendments at the work session. The Chair of the committee is likely to ask for comments from OPRD and the ATV users. If all goes well, the amendments will be adopted and the bill moved to the Ways & Means Committee for further action.
